Artist Consignment Contract

Terms / Conditions

Please read the following carefully before completing the contract. A copy of the completed contract will be emailed to you.

  • Artists may submit items for consignment sale in the Charles City Arts Center by making an appointment with the director.

  • A retail price must be marked on each piece of artwork - either labeled directly or tagged. Labeling requirements differ by artwork type and display method, as outlined below.

    • All 2-D artwork intended for hanging along the walls in the Galleria (e.g., canvases, framed items) must be tagged or labeled only on the back of the artwork, or in another manner that is fully concealed or removable during display, as the Arts Center applies standardized wall labels for all exhibited works.

    • All 3-D artwork and 2-D fine art prints (intended for display in a print rack) must be labeled or tagged by the artist prior to submission. No additional or alternate labels will be applied when these works are placed on display.

  • The Charles City Arts Center charges a 30% commission fee for all artwork sold. The remaining 70% of the retail price will be paid to the artist. Payments will be issued by check within 30 days of the end of the month in which the artwork sold.

  • All consigned artwork must be designed and created by the artist. Number of artworks placed on display at any given time is at the discretion of the Charles City Arts Center.

  • The artist must possess full title and rights to all artworks consigned for sale at the Charles City Arts Center.

  • All consigned artwork will be available for sale in the Charles City Arts Center Galleria and in the online Galleria store.

  • Applicable sales tax will be added at the time of sale and remitted by the Charles City Arts Center in accordance with state and local law.

  • Artwork must be inventoried upon submission by one of two methods, made available to the artist upon completion of a consignment contract. Each individual item for consignment must be listed and described.

    • Inventory may be hand documented on a paper form.

      • Completed paperwork may be dropped of, mailed, or emailed to the Charles City Arts Center upon completion.

      • The Arts Center is not liable for loss or destruction of the paper inventory document, and the artist will be solely responsible for retaining a copy.

      • The Arts Center will photograph each piece of consigned artwork and use the inventory form to list items for sale in the online Galleria.

        Please note, the Arts Center does not retain professional photographers for this service. The Arts Center will strive to photograph artwork in a way that mitigates risk of copyright infringement, but cannot be held liable for image theft

      • A $5 service fee is required for hand documented inventory submissions.

    • Inventory may be documented through an online portal submission.

      • A copy of the completed inventory form will be emailed to the artist upon submission. Additional copies may be emailed upon request.

      • Digital images of consigned artwork may be provided by the artist, for the purpose of online Galleria sales. Artists may copyright digital images as they see fit.

      • No service fee is required with this online inventory submission.

    • Artists may be asked to remove artwork remaining at the Arts Center unsold for more than six months. Artists will have 30 days from notification to retrieve artwork. Artwork not retrieved after that time may be held securely in storage while reasonable effort is made to contact the artist.

    • Inventory lists may be amended to add new/different items when artwork is removed (unsold) or sold. A new inventory submission must be made whenever new artwork is added for consignment.

    • All 2-D artwork must be mounted on a sturdy material and protected with either a clear professional covering or a frame.

    • Cards may be individual or packaged, and must be covered with a clear professional covering.

    • The Arts Center reserves the right to decline artwork that does not meet presentation or quality standards.

    • The artist grants the Arts Center permission to use images of consigned artwork for promotional and marketing purposes, including print and digital media.

    • Artwork condition will be noted at intake. The Arts Center is not responsible for pre-existing damage. The Arts Center will exercise reasonable care in the handling and display of consigned artwork.

    • The Charles City Arts Center is not responsible for loss of or damage to artwork which it holds for consignment for any reason, including but not limited to damage or destruction caused by fire, natural disaster, or theft. The Arts Center does not carry insurance on consigned artwork. It is the sole discretion and responsibility of the consigner to insure artwork.

By adding my signature below, I agree to the terms and conditions outlined in this contract for the purpose of selling my artwork, as artist and consigner, at the Charles City Arts Center. I understand the contract is valid until either either party (artist or Arts Center) elects to end the agreement.
